1. Services

Red Clay Landscapers LLC provides residential and small commercial landscaping services in Sophia and surrounding North Carolina communities. Our services include lawn mowing, landscape installation, seasonal cleanups, bush and shrub trimming, turf management, pressure washing, gutter cleaning, grading, and other related property maintenance work as scoped in writing for each project.

All services are subject to availability, scheduling, weather conditions, and site conditions. We reserve the right to refuse, postpone, or modify any service for safety reasons, legal reasons, payment concerns, unsafe site conditions, or any other reason at our reasonable discretion.

2. Estimates and Pricing

Estimates and quotes provided verbally, by phone, by text message, or by email are non binding unless and until provided in writing and accepted by both parties. Pricing is based on the scope of work as described at the time of the estimate.

The final price for a project may vary based on changes in scope, materials, site conditions, hidden obstacles, soil or drainage issues, additional work requested by the customer, or unforeseen circumstances discovered during the project. We will communicate any material changes to scope or pricing before performing the additional work whenever possible.

3. Payments

Our website does not collect or process payments. All payments for services are handled directly between Red Clay Landscapers LLC and the customer outside of the website.

Unless otherwise agreed in writing, payment is due in full upon completion of the work performed. We accept payment methods communicated at the time of service. Failure to make timely payment may result in late fees, suspension of future services, and lawful collection actions, including reporting to collections agencies and pursuing recovery through small claims court or other applicable legal channels in North Carolina.

4. Appointments and Property Access

The customer is responsible for ensuring our crew has safe and unobstructed access to the property on the scheduled service day. This includes:

• Securing all pets indoors or in a safe area away from the work zone
• Identifying and marking known hazards such as septic lines, irrigation lines, invisible fences, or buried utilities not visible from the surface
• Removing personal items, vehicles, or obstructions that may interfere with the work
• Providing access codes, gate keys, or other access mechanisms when needed

If access is unavailable on the scheduled day, the customer may be charged a trip fee or rescheduling fee at our discretion. We are not responsible for damage caused by undisclosed or improperly marked underground hazards.

5. SMS Messaging Terms

If you provide your phone number and consent to receive text messages from us, the following terms apply:

• SMS consent is not a condition of purchasing any service from us
• You may receive both service related messages (such as appointment confirmations and scheduling updates) and marketing or promotional messages
• To opt out of SMS messages, reply STOP at any time

• Message frequency varies based on your inquiries and our communications
• Message and data rates may apply depending on your wireless carrier
• Mobile carriers are not liable for delayed or undelivered messages

Our collection, use, and protection of personal information is governed by our Privacy Policy, which is available on our website. By using our website or services, you acknowledge that you have read and understand our privacy practices.

7. Intellectual Property

All content on the Red Clay Landscapers LLC website, including text, photographs, project images, logos, brand marks, and design elements, is owned by Red Clay Landscapers LLC or used with permission. All services are provided on an "as is" basis unless otherwise agreed in writing. We make no warranties or guarantees regarding specific outcomes, plant survival, growth results, exact completion timelines, or weather related delays unless explicitly agreed in a written quote or contract.

Landscaping work involves natural living materials and outdoor conditions that are inherently variable. Plant health, lawn growth, and landscape appearance depend on factors outside our control including weather, customer maintenance practices, soil conditions, and time. Project timelines may shift due to weather, equipment availability, or other factors beyond our reasonable control.

9. Limitation of Liability

To the fullest extent permitted by North Carolina law, Red Clay Landscapers LLC is not liable for indirect, incidental, special, consequential, or punitive damages arising from our services or your use of our website, including loss of profits, loss of property value, loss of use, or business interruption.

We are not responsible for delays, failures, or damages caused by circumstances beyond our reasonable control, including severe weather, natural disasters, supply chain disruptions, equipment failures, or labor shortages.

Our total cumulative liability for any claim arising from a service we performed is limited to the amount actually paid by the customer for that specific service. This limitation applies to the extent permitted by applicable law.

10. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any dispute arising from these Terms or our services shall be resolved in the state or federal courts located in Randolph County, North Carolina, or another North Carolina venue agreed to by both parties. The North Carolina Unfair and Deceptive Trade Practices Act (N.C. Gen. Stat. Section 75-1.1) and other applicable North Carolina consumer protection laws apply to our business practices.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, business practices, technology, legal requirements, or other operational reasons. Your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
